Constitutional and legal framework

The highest law of the country is called the constitution.The constitution is the primary source of other laws.A constitution is a social contract between the state and its citizens, that defines the structure of government and defines the basic rights and responsibilities of citizens.

Article 9:- Individual security

No person shall be deprived of life of liberty, except in accordance with the requirements of the law.

Article 10:- Protection from arrest and detention

  • Anyone arrested will be informed of the reasons of their arrest as soon as possible and will have the right to consult and consult a lawyer of their choice.
  • The arrested person will be produced before a magistrate within 24 hours and such arrested person will not be detained for more than the specified period without the permission of the magistrate. 
  • Provided that any of the matters mentioned in this article shall not apply to any person, who has been arrested or detained under the Prohibition of Detention Act.

Article 10 A:- The right to a fair hearing

Every citizen has the right to a fair trial and due process of law in order to determine his or her civil rights and obligations.

Article 11:- Prohibition of slavery and forced labor

  • Slavery is prohibited and no law will allow it to be practiced in Pakistan under any circumstances.
  • All forms of forced labor and the sale and purchase of human beings are not allowed.
  • No child under the age of fourteen shall be employed in any factory, mine or any other hazardous work.
  • convicted persons may be compelled to perform compulsory service and other citizens may be required to perform public service under the law, but such public service should be neither oppressive nor against human dignity.

Article 12:- Prohibition of punishment under new laws

  • No one shall be held guilty of any penal offense on account of any act or omission which did not constitute a penal offense, under national or international law, at the time when it was committed. 
  • No one can be punished more than the legal punishment for committing a crime.

Article 13:- Double punishment and protection against self-incrimination

A person cannot be tried twice for the same crime, nor can he be forced to testify against himself.

Article 14:- Obedience to human dignity

This privacy of the home is honorable and subject to the law, and no one shall be subjected to torturer to cruel, inhuman or degrading treatment or punishment.

Article 15:- Freedom of movement

Every citizen has the right to move and reside any part of the country subject to reasonable restrictions imposed by law.

Article 16:- Freedom of assembly

In the interest of public order, every citizen have the right to peaceful assembly, subject to restrictions imposed by law.
